In “Biased Evaluation of Pain and Suffering Damages” law professors Maytal Gilboa and Tamar Kricheli Katz provide experimental evidence of a causal relationship between the perceived race and gender of victims, the perception of their pain and suffering, and the damages awarded to them.

Focusing on head and knee injuries, the authors find that Black male victims receive significantly lower pain and suffering damage awards compared to all other groups. The study highlights troubling racial and gender disparities in subjective assessments and legal compensation.
